YAPPP — TERMS AND CONDITIONS OF USE Last updated: 17 September 2026 Effective from: 17 September 2026 Please read these Terms carefully before creating an account. By tapping "Continue" / "Sign in" / "I agree", or by using yappp in any way, you accept these Terms and our Privacy Policy. If you do not agree, do not use yappp. yappp is a map that shows real-world activities that other people are organising near you. yappp does not organise, host, run, supervise or vouch for any of those activities or the people at them. You go at your own risk. That sentence is the most important one in this document, and the rest of it explains what it means. 1. WHO WE ARE 1.1 "yappp", "we", "us" and "our" mean the operators of the yappp mobile application and the website yappp.in, Bengaluru, Karnataka, India. Contact: hello@yappp.in. 1.2 "You" means the person who creates an account or uses the Service. 1.3 "Service" means the yappp app, the yappp.in website, and everything we provide through them. 1.4 "Activity" means any event, plan, meet-up, game, session or gathering that a user posts as a pin on the map. 1.5 "Host" means the user who posts an Activity. "Attendee" or "Member" means a user who joins one. 2. WHO MAY USE YAPPP 2.1 You must be at least 18 years old. yappp is for adults meeting other adults. If you are under 18, you may not create an account, and if we learn that an account belongs to a minor we will delete it. 2.2 You must be legally able to enter into a binding contract under the Indian Contract Act, 1872. 2.3 You must not have been previously removed from yappp by us. 2.4 You must not be barred from using services like this under the laws of India or of wherever you are. 2.5 You may only use yappp for yourself. You may not create an account for someone else, and you may not create more than one account. 3. YOUR ACCOUNT 3.1 You sign in with a Google or Apple account. You are responsible for keeping that account secure. Anything done through your yappp account is treated as done by you. 3.2 You must give us true information. Your name and photo must be your own. Impersonating anyone, using someone else's photo, or misrepresenting your age or identity is grounds for immediate removal. 3.3 One photo of your face is required. It is shown to Hosts when you ask to join their Activity, so that they can decide who to let in. You may add up to three more photos, which are shown only to Hosts who have accepted you. 3.4 You can delete your account at any time from the You tab. Deleting your account removes your profile, photos and Activities from the map. Some records (for example, reports made about you or by you, and records we are legally required to keep) may be retained as described in the Privacy Policy. 4. WHAT YAPPP IS, AND WHAT IT IS NOT 4.1 yappp is a platform. It lets users post Activities and lets other users find and join them. yappp is an "intermediary" within the meaning of the Information Technology Act, 2000, and the content on it is created by users, not by us. 4.2 We do not: (a) organise, host, run, promote or endorse any Activity; (b) verify the identity, age, background, criminal record, health, qualifications, or intentions of any user; (c) verify that any Activity is real, safe, legal, or as described; (d) verify that any venue exists, is open, is safe, or permits the Activity; (e) supervise or attend any Activity; (f) take responsibility for anything that happens before, during or after an Activity, online or offline. 4.3 "Mutual friends" and "shared interests" shown at a Host's door are computed from information users gave us, and are not a recommendation, an endorsement, or a safety signal. 4.4 A Host accepting your request, or you accepting someone's request, is a decision made by a user, not by yappp. 5. MEETING PEOPLE IN PERSON — YOU ACCEPT THE RISK 5.1 yappp exists so that you meet people you do not know, in the real world. That carries real risks, and you accept them entirely. These include, without limitation: physical injury, illness, assault, theft, fraud, harassment, property damage, emotional distress, and death. 5.2 You are solely responsible for: (a) deciding whether to attend or host any Activity; (b) deciding whether to accept or meet any other user; (c) your own safety, belongings, and behaviour; (d) any physical activity you take part in (climbing, running, sport, cycling, trekking and the like carry inherent risk of injury; know your limits, use proper equipment, and follow the venue's rules); (e) checking that an Activity, and your participation in it, is legal; (f) any money you pay to anyone for anything connected with an Activity (tickets, entry fees, equipment, food, transport). yappp does not process payments and is not a party to those transactions. 5.3 We strongly recommend that you: meet in public places; tell someone where you are going; do not share your home address, financial details or personal documents; do not go alone to a private residence for a first meeting; leave immediately if anything feels wrong; and report anything that concerns you to us and, where appropriate, to the police (dial 112). 5.4 Nothing in the Service, including safety features such as approximate locations, approval doors, blocking and reporting, is a guarantee of your safety. These are tools, and they can fail or be circumvented. 6. HOSTING AN ACTIVITY If you post an Activity, you additionally agree that: 6.1 You are the organiser, and you are solely responsible for it: for its legality, safety, the venue, permissions and permits, equipment, and the conduct of the people you admit. 6.2 You have the right to use the venue for the Activity. Posting a pin at a location does not give you or anyone else any right to be there. 6.3 Your Activity must be described truthfully: what it is, where, when, how many people, and any cost, risk or requirement. 6.4 If you charge attendees anything, that is a transaction between you and them. You are responsible for any tax, licence or consumer-protection obligation that applies. yappp takes no part in it. 6.5 If you cancel, you must cancel in the app so that attendees are told. 6.6 You may not use an Activity to sell products or services, recruit for a business, multi-level marketing, religious or political organisation, or to gather people for any purpose other than the one described. 6.7 You must not host an Activity that requires alcohol, drugs, gambling, weapons, or anything illegal, or that is directed at minors. 6.8 If you choose an "open door", the exact location of your Activity is visible to every user who can see the pin. Choose an "approval door" if you want to vet people before they see where you are. 7. WHAT YOU MAY NOT DO You may not use yappp to, or in a way that: 7.1 Harasses, threatens, stalks, intimidates, bullies, or abuses anyone. 7.2 Is sexual, pornographic, or paedophilic, or that sexualises anyone, or that arranges or solicits sexual services or prostitution. 7.3 Promotes or glorifies violence, terrorism, self-harm, eating disorders, or dangerous acts. 7.4 Is hateful or discriminatory on the basis of religion, caste, race, ethnicity, gender, sexual orientation, disability, or any other protected characteristic, or that incites enmity between groups. 7.5 Is defamatory, obscene, invasive of another person's privacy, insulting to any person on the basis of gender, or in violation of any law. 7.6 Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or incites the commission of any cognisable offence. 7.7 Is false, misleading, or deceptive, including deepfakes or impersonation. 7.8 Infringes anyone's copyright, trademark, privacy, publicity or other rights. 7.9 Involves the sale or promotion of drugs, weapons, alcohol to minors, tobacco, counterfeit goods, or anything illegal to sell. 7.10 Collects, scrapes, or harvests information about other users, including their photos, names or locations, by any means, for any purpose. 7.11 Posts fake Activities, including to gather people's photos or to find out where they are. 7.12 Uses another person's photo, or a photo that is not of you, as your profile photo. 7.13 Spams, advertises, or sends unsolicited commercial messages. 7.14 Interferes with the Service: reverse-engineering, probing, scanning, overloading, attempting to bypass security or location redaction, using bots or automation, or accessing it by any means other than the official app. 7.15 Circumvents a block. If a user has blocked you, you may not contact them by any means, in the app or outside it, or create another account to do so. 7.16 Encourages anyone under 18 to use yappp or to attend any Activity. 7.17 Violates any applicable law of India or of the place where you are. We may remove any content and suspend or terminate any account that, in our judgement, breaks these rules, without notice and without liability to you. 8. YOUR CONTENT 8.1 "Your Content" means everything you put on yappp: your name, photos, bio, interests, Activities, notes, messages and reports. 8.2 You own Your Content. You give us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to host, store, reproduce, adapt (for example, resize and crop photos), display and distribute Your Content, for the purpose of operating, improving, securing and promoting the Service. This licence ends when you delete the content or your account, except where (a) another user has already seen or saved it, (b) it is in a backup that will be overwritten in the ordinary course, or (c) we are required to retain it by law or in connection with a complaint, investigation or legal proceeding. 8.3 You confirm that you have the right to post Your Content and that it does not violate Section 7. 8.4 We do not pre-screen content, but we may review, remove or restrict any content at any time for any reason. 8.5 Other users can see Your Content as described in the Privacy Policy. Once someone has seen it, we cannot un-see it for them. Do not post anything you would not want a stranger to see. 9. LOCATION 9.1 yappp needs your device's location to show you nearby Activities. We do not store your movement history, and other users are never shown your location. Only the location of an Activity you host is shown, and only to the extent described here. 9.2 For an "approval door" Activity, other users see a location that is deliberately offset by roughly 150 metres until the Host admits them. This is a mitigation, not a guarantee: it can be narrowed by repeated observation, by the place name the Host wrote, or by other users who have been admitted. If a location must stay secret, do not post it. 9.3 For an "open door" Activity, the exact location is visible to every user who can see the pin. 9.4 The map data comes from third parties and may be inaccurate, out of date, or wrong. Do not rely on it for navigation or safety. 10. SAFETY TOOLS, REPORTING AND ENFORCEMENT 10.1 You can block any user. A block removes both of you from each other's map entirely. We do not tell the other person. 10.2 You can report any user or Activity. Reports are reviewed by us. We may act on them, including by warning, restricting, suspending or removing accounts, and by cooperating with law enforcement. We may not be able to tell you what action we took. 10.3 We may suspend or terminate your account at any time, with or without notice, if we believe you have breached these Terms, if required by law, or if we believe it is necessary to protect users, third parties or yappp. We may also do so for any reason on reasonable notice. 10.4 If you are suspended or removed, you may not create another account. 10.5 We cooperate with law enforcement and courts. We may disclose your information, including your identity, location and content, where we believe in good faith that we are required to by law or that it is necessary to prevent harm. 11. GRIEVANCE OFFICER In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you may raise complaints about the Service or about content on it with our Grievance Officer: Name: [Grievance Officer name] Email: grievance@yappp.in Address: [Registered address], Bengaluru, Karnataka, India We will acknowledge your complaint within 24 hours and resolve it within 15 days of receipt. Complaints about content of the kinds listed in Rule 3(2)(b) of those Rules (for example, non-consensual intimate imagery or impersonation) will be acted on within 24 hours. 12. INTELLECTUAL PROPERTY 12.1 The yappp name, wordmark, app, website, design, code and everything in the Service other than Your Content and other users' content is ours or our licensors', and is protected by copyright, trademark and other laws. You may not copy, modify, distribute, sell, or create derivative works from any of it. 12.2 Map tiles and map data are provided by third parties under their own licences, including OpenStreetMap contributors under the ODbL. 12.3 If you send us feedback or suggestions, we may use them without any obligation to you. 13. THIRD-PARTY SERVICES 13.1 Sign-in is provided by Google and Apple. Push notifications are provided by Google (Firebase). Maps and geocoding are provided by third parties. Your use of those services is subject to their terms. We are not responsible for them. 13.2 Activities may take place at venues owned by third parties. Their rules apply. We have no relationship with them. 14. CHANGES TO THE SERVICE 14.1 yappp is a new product. We may change, suspend, restrict, or discontinue any part of it, or all of it, at any time, with or without notice. 14.2 Features may be added, removed, or changed. Features may not work as described. The Service may be unavailable. 15. NO WARRANTY 15.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. 15.2 WE MAKE NO WARRANTY ABOUT ANY USER, ANY ACTIVITY, ANY VENUE, OR ANYTHING THAT HAPPENS AS A RESULT OF USING THE SERVICE. 15.3 WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECT WILL BE CORRECTED. 16. LIMITATION OF LIABILITY 16.1 TO THE FULLEST EXTENT PERMITTED BY LAW, YAPPP AND ITS FOUNDERS, OPERATORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFIT, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, ANY ACTIVITY, OR ANY USER, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 16.2 IN PARTICULAR, AND WITHOUT LIMITATION, WE ARE NOT LIABLE FOR ANY PERSONAL INJURY, DEATH, ILLNESS, PROPERTY DAMAGE, THEFT, FRAUD, HARASSMENT, ASSAULT, OR OTHER HARM ARISING FROM ANY MEETING, ACTIVITY OR INTERACTION BETWEEN USERS, WHETHER ARRANGED THROUGH THE SERVICE OR NOT, OR FROM THE CONDUCT OF ANY USER OR THIRD PARTY. 16.3 TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, AND (B) INR 1,000. 16.4 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Consumer Protection Act, 2019, where it applies. 17. INDEMNITY You agree to indemnify, defend and hold harmless yappp and its founders, operators, employees, contractors, agents, licensors and suppliers from and against all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) Your Content; (c) any Activity you host or attend; (d) your breach of these Terms or of any law; (e) your violation of any right of any other person; or (f) any dispute between you and another user or third party. 18. DISPUTES BETWEEN USERS If you have a dispute with another user, it is between you and them. We are not obliged to become involved, and you release us from all claims, demands and damages of every kind, known and unknown, arising out of or connected with such disputes. This does not prevent you from reporting the user to us (Section 10) or to the authorities. 19. GOVERNING LAW AND JURISDICTION 19.1 These Terms are governed by the laws of India. 19.2 Subject to Section 19.3, the courts at Bengaluru, Karnataka, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. 19.3 Before going to court, you agree to first contact us at hello@yappp.in and attempt in good faith to resolve the dispute informally for at least 30 days. 19.4 Nothing in this section prevents either party from seeking urgent injunctive relief from any court of competent jurisdiction, or limits any right you have under the Consumer Protection Act, 2019, to approach a consumer forum. 20. CHANGES TO THESE TERMS We may change these Terms at any time. If the change is material we will tell you in the app or by email at least 7 days before it takes effect, unless the change is required by law or is needed to address a safety or security issue, in which case it may take effect immediately. Your continued use of the Service after the change takes effect means you accept the new Terms. If you do not accept them, stop using the Service and delete your account. 21. GENERAL 21.1 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. 21.2 Severability. If any part of these Terms is held to be invalid or unenforceable, the rest remains in force, and the invalid part is replaced by a valid one that comes as close as possible to its intent. 21.3 No waiver. Our not enforcing any part of these Terms is not a waiver of our right to enforce it later. 21.4 Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours to any successor or affiliate. 21.5 No agency. Nothing in these Terms makes you our employee, agent, partner or joint venturer, or us yours. Hosts are not our agents. 21.6 Survival. Sections 4, 5, 8.2, 12, 15, 16, 17, 18, 19 and 21 survive termination of your account or of these Terms. 21.7 Electronic acceptance. These Terms form an electronic record under the Information Technology Act, 2000, and do not require a physical or digital signature. Tapping "I agree" or continuing to use the Service is your acceptance. 21.8 Language. These Terms are in English. Any translation is for convenience only; the English version governs. 22. The IT Rules 2021 require a named officer resident in India and the details must be published on the app and website. - Set up grievance@yappp.in and hello@yappp.in mailboxes. - Google Play and the App Store both require a PUBLIC PRIVACY POLICY URL with sections on what data is collected (Google/Apple identity, name, photos, precise location, push token, interests, activities joined), why, how long it is kept, who it is shared with, and how to delete it, under the Digital Personal Data Protection Act, 2023. This document refers to it; it still needs to be written. - This document was drafted without a lawyer. Have one in Bengaluru read it before launch, particularly Sections 5, 16 and 17. Liability caps and assumption-of-risk clauses are enforced inconsistently by Indian courts and cannot exclude liability for negligence causing personal injury in many circumstances; what they can do is make the platform/organiser distinction clear, which is the argument that matters. - When the app supports it, record the version of the Terms each user accepted and the timestamp.
